1. Acceptance of Terms

By accessing or using WhenImGone (the "Service"), operated at whenigone.com and through our mobile application, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

WhenImGone is a digital emergency information platform that allows users to create a structured page containing essential information for their trusted contacts. The Service includes a check-in system that, when a user stops checking in, triggers an escalation process that may ultimately unlock the user's page for their designated trusted contact(s).

3. Important Disclaimers

Not a Legal Service: WhenImGone is not a substitute for a legally binding will, estate plan, power of attorney, or any other legal document. We strongly recommend consulting a qualified attorney for your estate planning needs.

No Guarantee of Timing: While we strive to deliver notifications and execute the escalation process reliably, we cannot guarantee exact timing of check-in reminders, escalation notifications, or page unlocks. Delays may occur due to network conditions, device settings, email delivery, or other factors beyond our control.

No Guarantee of Delivery: We cannot guarantee that your trusted contact will receive, open, or act on notifications sent by the Service. It is your responsibility to inform your trusted contact about WhenImGone and how it works.

4. User Accounts

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and recovery passphrase. You are responsible for all activities that occur under your account. You must be at least 13 years old to use the Service. If you lose your recovery passphrase, we cannot recover your encrypted data. We are not responsible for any loss resulting from a lost recovery passphrase.

5. Acceptable Use

You agree not to: use the Service for any unlawful purpose, store illegal content on the Service, attempt to gain unauthorized access to other users' data, interfere with the operation of the Service, use the Service to harass, threaten, or harm others, or create multiple accounts for abusive purposes.

6. Trusted Contacts

By adding a trusted contact, you confirm that you have the right to share the contact's email and/or phone number with us for the purpose of sending notifications as part of the escalation process. You are responsible for obtaining consent from your trusted contact before adding them to the Service. We will only contact your trusted contact as part of the escalation process or to confirm their role.

7. Subscriptions & Payments

The Service offers free and paid plans. Paid subscriptions are billed monthly or annually depending on your selection. Subscriptions purchased through the iOS app are processed by Apple and subject to Apple's terms. Subscriptions purchased through our website are processed by our payment provider. You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial billing periods.

8. Intellectual Property

The Service, including its design, code, features, and branding, is owned by WhenImGone. You retain ownership of all content you create and store on the Service. By using the Service, you grant us a limited license to store, process, and transmit your content solely for the purpose of operating the Service.

9. Limitation of Liability

To the maximum extent permitted by law, WhenImGone shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or damages resulting from delays in notification delivery, failure of the escalation process, loss of recovery passphrase, unauthorized access to unlocked pages, or service interruptions. Our total liability shall not exceed the amount you have paid us in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your account if you violate these terms. You may delete your account at any time through the app or by contacting us. Upon termination, your data will be deleted in accordance with our Privacy Policy.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Continued use of the Service after changes constitutes acceptance.
